Attorney Bar Association of Slovenia: Warming up for .si violations
The Attorney Bar Association of Slovenia has roots dating back to 1849, when the first provisional regulations governing the legal profession were introduced. A formal framework followed in 1868 with the adoption of the Lawyers’ Order, establishing the principle of independence for practicing attorneys.
The Slovenian legal profession has since evolved through ten Bar Acts, with the modern framework established in 1993. Under Article 137 of Slovenia’s Constitution, the Bar operates as an autonomous and independent part of the country’s judicial system.
Today, the Bar Association of Slovenia is organized into 11 regional assemblies, representing attorneys who practice independently while adhering to national legislation, professional ethics, and European legal standards.
Domain name disputes involving .si domains are handled through Slovenia’s Alternative Domain Dispute Resolution (ARDS) procedure, administered by Register.si.
Similar to the UDRP used for .com and other extensions, ARDS provides a legal framework for challenging domain registrations that infringe upon trademarks, company names, and other protected rights.
To succeed, complainants must demonstrate that the disputed domain infringes their recognized rights, that its holder lacks a legitimate interest, and that the domain was registered or is being used in bad faith. Successful complaints can result in the transfer or deletion of the domain.
As interest in .si domain registrations grows, trademark owners and businesses encountering potentially infringing registrations may seek assistance from Slovenian attorneys experienced in intellectual property and domain disputes.
Legal representation is not mandatory under ARDS, but qualified attorneys with Slovenian presence can help evaluate claims, prepare evidence, defend legitimate domain ownership, and pursue court proceedings when necessary. The procedure does not eliminate either party’s right to seek judicial protection.
